A BILL
To amend the Immigration and Nationality Act to provide for the removal of aliens who aid or abet a terrorist organization or an individual who has conducted, is conducting, or is planning to conduct a terrorist activity.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. SHORT TITLE.
This Act may be cited as the `Keeping America Safe Act of 2001'.
SEC. 2. REMOVAL OF ALIENS WHO AID OR ABET TERRORISTS OR TERRORIST ORGANIZATIONS.
(a) INADMISSIBLE ALIENS- Section 212(a)(3)(B) of the Immigration and Nationality Act (8 U.S.C. 1182(a)(3)(B)) is amended--
(1) in clause (i), by amending subclauses (IV) and (V) to read as follows:
`(IV) is a representative (as defined in clause (iv)) of a terrorist organization, including an organization designated as a foreign terrorist organization by the Secretary under section 219, or
`(V) is a member of a terrorist organization, including an organization designated as a foreign terrorist organization by the Secretary under section 219,'; and
(2) in clause (iii)--
(A) in subclause (IV), by striking `organization.' and inserting `organization, including an organization designated as a foreign terrorist organization by the Secretary under section 219.';
(B) in subclause (V), by striking `organization,' and inserting `organization (including an organization designated as a foreign terrorist organization by the Secretary under section 219),'; and
(C) by adding at the end the following:
`(VI)(aa) Any other act committed by an alien that constitutes aiding or abetting another individual who has conducted, is conducting, or is planning to conduct a terrorist activity, or aiding or abetting a terrorist organization, including an organization designated as a foreign terrorist organization by the Secretary under section 219.
`(bb) For purposes of this subclause, the term `aiding or abetting' means (AA) giving aid or comfort to another individual who an alien knows or reasonably should know has conducted, is conducting, or is planning to conduct a terrorist activity; (BB) providing funds or any other thing of value to a terrorist organization; (CC) commanding, advising, instigating, or encouraging another individual or a terrorist organization to conduct a terrorist activity; or (DD) with knowledge that another individual or a terrorist organization has conducted a terrorist activity, failing to report such activity to any Federal or State law enforcement authority in the United States or to any international law enforcement authority in a country that is not a State sponsor of terrorism (as defined by the Secretary of State) or receiving, relieving, comforting, or assisting such individual or organization in order to hinder or prevent the apprehension, trial, or punishment of the individual or organization.'.
(b) DEPORTABLE ALIENS- Section 237(a)(4)(B) of the Immigration and Nationality Act (8 U.S.C. 1227(a)(4)(B)) is amended to read as follows:
`(B) TERRORIST ACTIVITIES- Any alien is deportable who is within the class of aliens inadmissible under subclause (I), (III), (IV), or (V) of section 212(a)(3)(B)(i).'.
